Activity
The Legal Department is a structural subdivision of ChNU, which is directly subordinated, controlled and accountable to the rector.
The Legal Department in its activities is governed by the Constitution of Ukraine, Laws of Ukraine, Resolutions of the Verkhovna Rada of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, normative acts of the Ministry of Education and Science of Ukraine, other central bodies of the executive power of Ukraine, the University Charter, orders and orders of the rector.
Functions of the Department:
- organizing and ensuring the correct implementation of legislative acts, other regulatory acts and documents, submitting proposals to the management regarding the resolution of legal issues of the university's activities;
- the department coordinates the work and takes a direct part in the preparation of orders and other acts of the university regulating the relations of structural divisions, their property responsibility, etc.;
- the department verifies compliance with legislation of draft orders, other acts submitted for signature to the rector, and approves them if these drafts are approved by the interested units;
- together with other structural subdivisions, the department draws conclusions based on draft orders and other acts, prepares and submits, in the prescribed manner, proposals to change or cancel departmental regulations and university acts that have actually lost their validity, do not meet business conditions, or were issued in violation of legislative requirements;
- supervises compliance with the legislation of acts adopted by heads of structural units, reports to the rector to take measures to change or cancel them;
- the department participates in the preparation, conclusion and monitoring of the execution of business agreements (contracts) with other enterprises, institutions and organizations, provides a legal assessment of their projects;
- organizes claims and conducts lawsuit work; represents the university's interests in courts and other bodies during consideration of legal issues and disputes in accordance with the procedure established by law; provides a legal assessment of claims presented to the university or by the university in connection with the violation of its property rights and legal interests;
- analyzes the consequences of considering claims, lawsuits and court cases, the practice of concluding and executing agreements (contracts); submits proposals to the head of the university regarding the improvement of legal support for economic activity;
- gives conclusions regarding the legality of write-off of material assets, receivables, non-productive expenses and legal assessment of the facts of shortages, thefts, mismanagement, damage to property; examines materials on compensation at the expense of persons guilty of material damage, which are prepared by relevant units based on the economic and legal analysis of accounting data and statistical reporting, other documents of the university's financial and economic activities, and materials of inspections carried out by law enforcement and control bodies;
- promotes the observance of legality in the exercise of the rights of the labour collective; participates in the preparation and conclusion of a collective agreement, advises the elected bodies of the labour collective on legislative issues related to their powers;
- together with the relevant units of the university, participates in the preparation of measures to strengthen labour discipline, ensure labour protection; provides legal assistance to university employees who need social protection;
- ensures the correct application of labour, housing, pension, and other legislation affecting the rights and legitimate interests of employees, makes proposals to the rector to restore violated rights; in case of non-fulfillment of the requirements of the legislation, when the employee is dismissed from work, transferred to another job, or brought to disciplinary or financial responsibility, gives a written opinion with proposals for eliminating the violations;
- keeps records of acts of legislation and international treaties of Ukraine, ensures their maintenance in a controlled state and storage;
- collects information on the official publication of legislative acts in printed publications;
- participates in ensuring compliance with the legislation on environmental protection and taking measures aimed at preventing its violations;
- promotes the timely implementation of measures based on protests and submissions of the prosecutor's office, individual court rulings, decisions, resolutions, rulings of the commercial court, relevant documents of other law enforcement and control bodies;
- organizes and conducts work related to increasing the level of legal knowledge of university employees, informs about the legislation, explains the existing practice of its application; gives advice on legal issues.
